These are the Minutes from  MONDAY October 5th and NOT a decision Judge Carter indicated he would provide (tentatively) by Wednesday October 7th on the Motion to Dismiss he took uner advisement



1) The Motion to Dismiss was taken under advisement and NO decision has been made.



2) The Civil Minutes below are simply Housekeeping to firm up the dates previously proposed and now FIRMED up as the offical scheduling that will be followed IF THE CASE PROCEEDS.



3) This announcement does NOT indicate that the case will proceed though it MIGHT indicate that Judge Carter is doing his housekeeping duties in case he decides to rule that it should continue.



If he were leaning to dismissing it, he MAY just MAY have not bothered with this but it would leave the case file incomplete. And Judge Carter is meticulous and detail oriented.
